General Terms of Service
These General Terms and Conditions apply to all services offered by Slimme Werkoplossingen & Services (SWS), pertaining to construction, renovation, and carpentry work.
1. Acceptance of Terms
By engaging our services, requesting a quote, or using our website, you accept and consent to be bound by these General Terms and Conditions. If you do not agree with any part of these terms, you should not use our services.
2. Services Provided
SWS provides professional construction and renovation services including, but not limited to:
- Window repair and installation
- Glass replacement and sealing work
- Interior and exterior painting
- Woodworking and custom furniture
- Door installation and repair
- General construction and renovation work
3. Quotations and Estimates
- All quotations are valid for a period of 30 days, unless otherwise agreed upon in writing.
- Quotations are based on the information provided by the client at the time of assessment.
- Changes to the scope of work may result in additional charges.
- Final pricing may vary if site conditions differ from initial assessment.
4. Payment Terms
- A deposit of 30% may be required before work commences.
- Payment is due within 14 days of invoice date unless otherwise agreed.
- Late payment may incur additional charges and/or statutory interest.
- We reserve the right to suspend work for non-receipt of timely payment.
5. Client Responsibilities
The client is obliged to:
- Provide accurate information about the project requirements.
- Ensure safe access to the work area.
- Remove or adequately protect personal belongings in the work area.
- Inform us of any hazards or special conditions in a timely manner.
- Make timely payments according to agreed terms.
6. Work Schedule and Completion
- Work schedules are estimates and may be affected by Force Majeure, material availability, or unforeseen circumstances.
- We will notify clients of any significant delays.
- Completion dates are approximate, unless specifically guaranteed in the written agreement.
7. Warranty and Guarantee
- We provide a warranty on our workmanship as specified in the individual agreements.
- Materials are covered by manufacturer warranties.
- Warranty does not cover normal wear and tear or damage caused by misuse or negligence.
- Warranty claims must be reported in writing within 30 days of discovery.
8. Liability and Insurance
- SWS carries appropriate liability insurance for all work performed.
- Our liability shall at all times be limited to the invoice value of the work performed.
- We are not responsible for pre-existing conditions or hidden defects.
- Clients are responsible for obtaining necessary permits, unless otherwise agreed upon in writing.
9. Changes and Variations
- Changes to the agreed scope of work must be pre-approved and recorded in writing.
- Additional work will be charged at prevailing rates.
- We reserve the right to refuse unreasonable requests for changes.
10. Cancellation Policy
- Cancellations with less than 48 hours notice may incur charges.
- Materials ordered for your project may be charged if cancellation occurs after the order date.
- Deposits may be non-refundable if work has commenced.
11. Health and Safety
- All work is performed in accordance with Dutch health and safety regulations.
- We maintain appropriate safety equipment and procedures.
- Clients must ensure a safe working environment.
12. Data Protection
- We handle personal data in accordance with our Privacy Policy.
- Client information is kept confidential and secure.
- We may use project photos for marketing purposes unless specifically declined in writing by the client.
13. Dispute Resolution
- Any disputes shall primarily be resolved through good-faith negotiation.
- If resolution cannot be reached, disputes will be subject to Dutch law.
- All disputes shall be exclusively submitted to the competent court in Amsterdam.
14. Force Majeure
We are not liable for delays or failures due to circumstances beyond our reasonable control (Force Majeure), including, but not limited to, weather conditions, material shortages, labor disputes, or government restrictions.
15. Modification of Terms
We reserve the right to modify these terms at any time. Updated terms will be posted on our website with the revision date. Continued use of our services constitutes acceptance of the modified terms.
